Welcome to the Las Vegas Film Festival website. These Terms and Conditions of Use (the "Terms") govern your access to and use of the websites, online services, content, submission-related features, ticketing or pass information, and other digital services operated by Las Vegas Film Festival LLC (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Las Vegas Film Festival is a trade name of Las Vegas Film Festival LLC (the "Company," "we," "us," or "our"). The Company operates websites including lasvegasfilmfestival.com, filmfestival.vegas, and thelasvegasfilmfestival.com, together with related pages, features, and digital services.
These Terms apply to visitors, registered users, filmmakers, project submitters, ticket or pass purchasers, accredited media, sponsors, partners, and other persons who access or use the Service. Certain activities may also be governed by additional written rules, submission agreements, ticket terms, accreditation terms, sponsorship agreements, privacy policies, or third-party platform terms. If a specific written agreement conflicts with these Terms regarding the same subject matter, the more specific agreement will control.
1. Acceptance and Changes to Terms
By accessing or using the Service, you represent that you have read, understood, and agreed to these Terms. We may revise these Terms from time to time. The revised Terms become effective when posted unless a later effective date is stated. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to enter into transactions or binding agreements through the Service. If you use the Service on behalf of an organization, Company, production, or other entity, you represent that you have authority to bind that entity.
3. Limited Right to Use the Service
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for lawful personal, informational, submission, accreditation, ticketing, or business-interaction purposes expressly permitted by the Company.
The Company may modify, suspend, restrict, or discontinue all or any portion of the Service at any time, subject to applicable law and any separate written agreement.
4. Accounts and Registration
Certain features may require an account or registration through the Company or a third-party platform. You agree to provide accurate, current, and complete information; maintain the confidentiality of your credentials; and promptly notify the applicable provider of unauthorized use. You are responsible for activity conducted through your account to the extent permitted by law.
5. Film and Project Submissions; Fees
The Company may accept film, episodic, short-form, social/vertical, podcast, music video, and other project submissions directly or through third-party submission platforms. Submission eligibility, deadlines, fees, judging, selection, exhibition requirements, awards, and related rights are governed by the then-current Company Rules & Terms and any applicable submission-platform terms.
Submission fees and other fees are non-refundable except where expressly stated by the Company or required by law. Payment processing may be performed by third parties. Submission does not guarantee selection, screening, nomination, award, distribution, acquisition, press coverage, or any other outcome.
6. Tickets, Passes, Credentials, and Events
Tickets, passes, credentials, invitations, and event access may be subject to availability, capacity, venue rules, security requirements, age restrictions, separate terms, and schedule changes. A pass or credential does not guarantee admission to every screening, party, gala, panel, or special event unless expressly stated.
The Company may change programs, films, guests, venues, schedules, screening formats, or event details when reasonably necessary. Refunds, exchanges, and transferability are governed by the terms disclosed at purchase and applicable law.
7. Intellectual Property
The Service and its compilation, selection, arrangement, design, graphics, text, logos, trademarks, service marks, photographs, videos, audio, software, and other materials are owned by or licensed to the Company and are protected by applicable intellectual-property laws.
Third-party films, trailers, stills, artwork, music, photographs, promotional materials, and other content remain the property of their respective owners or licensors. No ownership interest is transferred to you by your use of the Service.
Except as expressly authorized, you may not copy, reproduce, republish, distribute, modify, publicly display, publicly perform, sell, license, scrape, commercially exploit, or create derivative works from Service content.
8. Las Vegas Film Festival Marks
The Las Vegas Film Festival name, logos, festival branding, and associated marks are proprietary to Las Vegas Film Festival LLC. You may not use them in a manner that falsely suggests endorsement, sponsorship, partnership, affiliation, or official status without prior written authorization.
9. User Content
If you submit comments, reviews, photographs, posts, testimonials, or other user-generated material through the Service ("User Content"), you retain ownership of your User Content but grant the Company a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute, and use it as reasonably necessary to operate, promote, and improve the Service and the Company activities.
You represent that you have the rights necessary to provide the User Content and that it does not violate law or third-party rights. Film and project submissions are governed separately by the applicable Company submission rules and agreements.
10. Acceptable Use and Site Security
You may not use the Service for unlawful, fraudulent, abusive, infringing, or unauthorized purposes; attempt to gain unauthorized access to systems, accounts, or data; introduce malicious code; interfere with the operation of the Service; circumvent security measures; impersonate another person; harvest personal information; or use automated tools in a manner that imposes an unreasonable burden or violates these Terms.
The Company may investigate suspected violations and may restrict or terminate access where reasonably necessary to protect the Service, the Company, users, partners, or third parties.
11. Third-Party Platforms, Links, and Services
The Service may link to or integrate with third-party websites, submission services, ticketing providers, payment processors, social-media platforms, advertisers, venues, streaming services, or other providers. Those services are governed by their own terms and privacy practices. The Company does not control and is not responsible for third-party services except to the extent required by law or expressly agreed in writing.
12. Advertising, Cookies, and Analytics
The Company may use analytics, cookies, pixels, and similar technologies and may display or work with sponsors and advertisers. Information concerning data collection and use is described in the Company Privacy Policy and applicable cookie disclosures.
13. Privacy
Your use of the Service is also subject to the Company Privacy Policy. Questions concerning privacy or personal data may be directed to datasupport@lasvegasfilmfestival.com or another privacy contact identified in the then-current Privacy Policy.
14. Copyright and DMCA
The Company respects intellectual-property rights. Copyright complaints concerning material available through the Service should be submitted in accordance with the Digital Millennium Copyright Act and the Company's posted DMCA Copyright Policy or designated-agent instructions.
A valid notice generally must identify the copyrighted work, identify the allegedly infringing material and its location, provide sufficient contact information, include the required good-faith and accuracy statements, and include the signature of an authorized person. Users should consider whether a use may be authorized by law, including fair use, before submitting a notice.
15. Content and Program Information
The Company endeavors to provide accurate information, but festival schedules, selections, guests, programs, venues, awards, sponsors, availability, and other information may change. Unless expressly stated in a binding written agreement, information on the Service is provided for general informational and promotional purposes and does not constitute a guarantee of any particular result or opportunity.
16. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
The Company does not warrant that the Service will be free of viruses, security vulnerabilities, interruptions, errors, or harmful components, or that information obtained through the Service will always be accurate, complete, or current.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, LICENSORS, OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, SPONSORS, PARTNERS, CONTENT PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, BUSINESS INTERRUPTION, OR SIMILAR LOSSES ARISING FROM OR RELATING TO THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID DIRECTLY TO COMPANY IN CONNECTION WITH THE MATTER GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 IF YOU PAID NOTHING, EXCEPT WHERE A DIFFERENT LIMIT IS REQUIRED BY LAW.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, managers, employees, contractors, agents, licensors, sponsors, partners, and representatives from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Service, your material breach of these Terms, your User Content, or your infringement or violation of third-party rights.
19. Suspension and Termination
The Company may suspend or terminate access to the Service for a material violation of these Terms, suspected fraud or security threats, unlawful activity, or conduct that may harm the Company, the Service, users, partners, or third parties. Provisions that by their nature should survive termination will survive.
20. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except to the extent federal law applies.
21. Dispute Resolution and Arbitration
Except where prohibited by law or where the parties agree otherwise in writing, disputes arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by the American Arbitration Association under the rules applicable to the dispute. The arbitration shall be conducted in Clark County, Nevada, unless the parties agree to another location or remote proceeding.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief from a court of competent jurisdiction to protect intellectual-property rights, confidential information, security, or against unauthorized use while arbitration is pending. Any matter not subject to arbitration shall be brought in a court of competent jurisdiction in Clark County, Nevada, subject to applicable federal jurisdictional rules.
22. International Users
The Service may be accessible internationally. You are responsible for compliance with laws applicable to your access and use. The Company makes no representation that every feature, transaction, program, or offering is lawful or available in every jurisdiction.
23. No Waiver; Severability
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. The Company 's failure to enforce a provision is not a waiver of its right to do so later.
24. Effect of Other Agreements
These Terms do not replace a separate written submission agreement, sponsorship agreement, license, filmmaker agreement, ticketing term, accreditation agreement, participation agreement, privacy policy, DMCA policy, or other specific agreement between you and the Company. Where a specific agreement governs a particular transaction or activity, that agreement controls to the extent of a conflict.
25. Entire Agreement
These Terms, together with policies and specific agreements expressly incorporated by reference, constitute the agreement between you and the Company concerning your general use of the Service.
